Terms of Service

These Terms of Service (the "Terms") form an agreement between you and DrawlyHub ("we", "us") governing your use of the collaborative drawing and whiteboarding service at drawlyhub.com (the "Service"). By accessing or using the Service, including as a signed-out visitor, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

1. Eligibility and accounts

You must be at least 13 years old and capable of forming a binding contract in your jurisdiction to use the Service. You access the Service using a Google account, and you are responsible for all activity that occurs under it. You agree to notify us promptly at support@drawlyhub.com if you believe your account has been used without your authorization.

The Service may also be used without an account. A board created in that manner is temporary: it expires 24 hours after creation, only one such board is available at a time, and it becomes permanent only if you create an account before it expires.

2. Your content

You retain all rights you already hold in the material you create, upload, or store using the Service ("Your Content"). You grant us a limited, non-exclusive, royalty-free license to host, store, reproduce, and display Your Content solely to operate the Service and to make it available to you and to those you authorize. This license exists only for that purpose and ends when Your Content is deleted.

We do not use Your Content for advertising, and we do not sell it. You represent that you hold the rights necessary to upload and share the material you submit, including any images.

3. Acceptable use

You agree not to use the Service to:

• violate any applicable law or infringe the rights of any person;
• store, transmit, or share material that is unlawful, defamatory, harassing, or abusive;
• upload malicious code, or material designed to harm those who open it;
• access boards, accounts, or data you are not authorized to access, or to probe, scan, or disrupt the Service or the infrastructure supporting it;
• resell or commercially redistribute the Service, or use it in a manner that impairs its availability for others.

We may suspend or terminate access to an account or remove content that we reasonably believe breaches this section. Where we do so, we will endeavor to inform you of the reason.

4. Sharing and links

A view-only link makes a board readable by any person who holds that link, without an account and without further verification. This is the intended function of the feature. You are responsible for the distribution of links you create and for revoking them when a board should no longer be accessible. Decisions about what to share, and with whom, rest with you.

5. Service limits and modifications

The Service operates within defined limits, which may change as the product develops. At present an account may hold a limited number of boards, a board a limited number of frames, and a frame a limited number of objects; uploaded images are subject to a maximum file size. We may add, modify, or discontinue features, and certain features are enabled or disabled as development proceeds. We will not knowingly remove your ability to export your own content from the Service.

Some features, now or in the future, may be available only on a paid plan, and the limits and features each plan includes may change.

The Service offers a free plan and a paid Pro plan. Pro is billed monthly in advance through our payment processor and renews automatically until you cancel. You can cancel at any time from your profile; Pro then continues until the end of the period you have paid for. Payments already made are not refunded automatically, except where the law requires it; if something has gone wrong, write to support@drawlyhub.com and we will consider a partial refund. We will tell you before a change to the price of a subscription you hold takes effect.

If Pro ends, nothing you created is deleted. Your boards, their frames and saved versions remain yours to open and edit, but you cannot create boards or frames beyond the free plan's limits, or use features that are only on Pro, until you subscribe again.

6. Deletion and termination

Deleting a board moves it to Trash, where it remains restorable for 30 days. After that period it is permanently deleted together with its contents and cannot be recovered.

You may stop using the Service at any time and may request closure of your account by writing to support@drawlyhub.com. We may suspend or terminate your access where you materially breach these Terms, or where required by law.

7. Disclaimer of warranties

To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that content will never be lost. You are encouraged to retain your own copies of material you cannot afford to lose; export tools are provided for this purpose.

8. Limitation of liability

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for any loss of profits, data, business, or goodwill, arising out of or in connection with your use of the Service, whether based in contract, tort, or any other theory of liability. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

9. Indemnity

You agree to indemnify and hold us harmless from any claim or demand, including reasonable legal fees, brought by a third party and arising out of Your Content, your use of the Service, or your breach of these Terms.

10. Privacy

Our handling of personal information is described in the Privacy Policy, which is incorporated into these Terms by reference.

11. Changes to these Terms

We may revise these Terms from time to time. The date at the top of this page reflects the current version, and we will notify you within the Service before a material change takes effect. Your continued use of the Service after a revision takes effect constitutes acceptance of the revised Terms.

12. General

If any provision of these Terms is held unenforceable, the remaining provisions remain in full force. Our failure to enforce a provision is not a waiver of it. These Terms constitute the entire agreement between you and us regarding the Service.
